By accessing or using SendHEP ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

SendHEP is a web-based tool that allows healthcare professionals to create, manage, and share home exercise programs with clients. The Service includes a library of exercises, program building tools, PDF generation, and shareable links.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Professional Use

SendHEP is intended for use by licensed healthcare professionals. The exercise programs and content provided are for educational purposes and should be used in conjunction with proper clinical judgment. You are solely responsible for ensuring that any exercise program you create is appropriate for your client's condition and abilities.

5. Pricing & Payments

Free Tier: New users receive 10 free programs with full functionality.

Paid Plans: Unlimited programs can be purchased via lifetime access. All prices are in USD. Current one-time pricing is introductory; future pricing may transition to subscription.

6. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Attempt to circumvent usage limits or billing
  • Copy, modify, or distribute our exercise content library
  • Use automated systems to access the Service
  • Interfere with or disrupt the Service

7. Intellectual Property

The Service, including its exercise library, images, and software, is owned by SendHEP and protected by copyright and other intellectual property laws. You may use the exercise content solely for creating programs for your clients. You may not redistribute, sell, or repurpose our content library.

8. Your Content

You retain ownership of any custom exercises or content you create. By using the Service, you grant us a license to store and display your content as necessary to provide the Service. We will not share your content with third parties except as required by law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability

To the maximum extent permitted by law, SendHEP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SendHEP from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Previously created share links may continue to work for client access.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Significant changes will be communicated via email or in-app notification.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
